Is there anything I can do about a loan I found out was entered in my name only?

I co-signed a loan for my brother to get a harley back in the summer. He lost his job and can't make the payments now. I just found out that they never put his name on anything and the loan was obtained using my name only, without my knowledge, though all of the paperwork we signed had both our names on it. He as the loan holder and me as co-signer. Are they allowed to do that?

NEVER NEVER COSIGN A LOAN. If the other party defaults, YOU are on the hook for paying the loan, and YOUR credit rating gets ruined if the loan isnt paid…


Answer:YOU agreed to cosign. Even if you brother had done everything the way you thought, you would STILL be 100% liable for what he would not be paying. You can TRY to sue him for what you WILL pay the lender, but I doubt you will be able to collect, even if you win.

Answer:You can probably go back to the lender and add your brother's name to the loan, based on the copy of the paperwork that you signed. Hopefully you have a copy of that. However, what you cannot do is take your name off the loan, so the result will still be the same – you will be responsible for the payments.

Since the lender thought you worthy as a co-signer, you will probably be able, with sacrifices, to make the payments. Is your brother honorable? Will he agressively seek another job, then resume payments, and pay you back for the portion where you covered for him? If that's not the case, the bike should be sold now to reduce the debt. It's unlikely that the proceeds would fetch enough to pay off the loan, though – you would still be responsible for that.


Answer:Yes. Cosigning means that you are fully responsible for the loan if he defaults. Expect your credit to suffer considerably. And you can not get your name "off" the loan. Since the bike is probably now worth much less than it was when you bought it (if it was new) you are going to have a hard time selling it for a high enough price to pay off the loan. Call the finance company and see if there is anything you can work out.

Has long as you had the comprehensive coverage, the door was not left unlocked there are no issues for your son. The insurance company will pay for the claim, subject to no fraud and misrepresentation.

I work at a place where I've had a coworker threatening & harassing me which they do also to other coworkers. They have done it in front of management & nothing has ever been done about it. Can I please get some advice on what to do here? Thanks


Answer:For your own protection, get an attorney.

THE best way to find a lawyer is by word of mouth. Ask your: family, friends, coworkers, anyone you might know in the same situation, etc.

OR

Call your local (usually county) bar association. Ask for names of attorneys that handle Employment law for employEES. (If money is a BIG problem, you could also ask for the phone number of your local LegalAid office. – the attorneys at LegalAid are "real" attorneys, but sometimes in the field of Law, how much you are willing to pay does affect the quality you get.)

When you call the law office(s), insist on speaking with the Lawyer. Just tell the Secretary the main idea of your matter – do not tell all the little details of your matter to the Secretary – save the details for the Attorney. When you get the Lawyer on the phone line, ask him/her:

- Do they give >>>FREE, initial consultations for the FIRST meeting? (most do, but not all – you have to ask, don't assume)

- How much do they charge?

- Could you make payments on your account?

- Can they help you? OR Refer you to someone who can help you?

Set him up-see if this idiot harasses in front of others. Ask a coworker to have their cell phone ready, and when this idiot acts up, to start taping, if possible. Immediately walk away. No arguments, no confrontations. Document. Never mind management's ignoring the situation. I'll explain why you should make that statement later on. You are going to build a slow, methodical case.

Document-dates, full name/title/department of coworker, particular behavior towards you (harassment,yelling, aggressive, etc. verbatim), any threatening gestures towards you (i.e. in your face), any witnesses, i.e. management (be specific with names, etc.). Your boss gets a copy.

If you're Union, contact your union rep, show him your documentation(s).

No resolution from your boss? Next time, or any time your coworker acts like a schoolyard kid towards you, or any other coworker-keep documenting. This time, send copies to management, including your initial one you sent your boss. You're showing that you're methodically going up the chain-of-command.

No resolution from management and coworker's still misbehaving? Keep documenting. It's time to notify the owner, or whoever's above management, i.e. Company President. Send him a copy along with ALL other copies you've sent to your boss and management.

I hope this doesn't happen, but if you're fired on some unfounded charge, or because you "dared to speak up and document this hostile environment", call a labor lawyer, give him all of your documentations. They will turn into legal evidence, admissible in court.

Understand that your coworker and management could lie and claim "nothing happened." They've got words=hearsay. You'll have written (and hopefully video) proof you worked in a hostile environment, starting from when you asked your coworker to stop harassing you, nothing was done, you then notified management, nothing was done, you then notified a higher-up – and nothing was done. You went up the chain of command, didn't bypass anyone in authority and was ignored.

Commuting's bad enough. Commuting to a minefield workplace is worse. There's no reason for it.

Answer:That shouldn't matter, what there more concerned with is injuries or problems with joint problems or anything that you could make worse if you were to go through basic training. Bad knees/ankles/backs/shoulders etc They expect people to have been to the doctors within the last 2/3 years just don't want people who have conditions that could be made worse or leave them unable to complete the physical parts of basic training and daily work duties. Bad eyes/hearing is another thing they look for.

Do you have to abide by rental laws if your looking for a roomate?

My wife moved out, and so I'm looking for one or 2 people to move in in my empty rooms in my house, but share the rest of the rooms with me.

I know for example that if you are renting a house, you can't turn someone down because they have kids. Can I turn someone down because they have kids if Its my house where I'm living? Can I dictate sex? (for example, my mother would flip out if she found out I had a girl staying in my house, so can I only allow guys?)

I was going to post up a listing and get the word out that I'm looking for roommates, but I wanted to know what I'm allowed to limit potential people by.


Answer:Because you are occupying the property, you can establish whatever rules you want with regard to who will live with you.

However, definitely have written leases (even if they will only be paying you month to month if that's what you want) so everyone knows what the rules are. You don't want one of the guys bringing in his druggie girlfriend to live in his room (only by way of example :) ). Also, study up on the landlord/tenant rules for your state, so you can see what you need to do to legally evict them if they break the terms of the lease (don't pay you), what you can and can't do with prepaid rent and security/damage deposits, etc.

I'd recommend watching Judge Judy for a couple of weeks; if that doesn't cool you on this idea at least you will know what you have to prepare for.

Good-morning America :-) , I have a question for you. If I am a housewife (I am) and my husband gives/pays me $1,000 every two weeks for doing my housewife duties, (cooking, cleaning, taking care of the baby 24-7, doing our accounting/budgeting) but I also have to use that money for expenses, (buying cleaning supplies, buying diapers for the baby and baby food, buying groceries to cook etc…) can I save my receipts and get all or some of that written off of my taxes since I am buying things for my job? If yes, where does the line draw? If I pay the light bill with that money can I write that off too since I need that to perform my job? And the water too? What about buying a washing machine and a dryer? And the gas that I use to go grocery shopping and to pay bills? I have talked to a girl whose job it is to look good, and she can write off any makeup that she buys, boob jobs, getting her hair and nails done, if this is true for her, is it true for us housewives? Answer:This money was after-tax money from you husband on which you paid no income tax. Therefore you have nothing to write off since your activites do not technically meet the definition of employment. Yes it is cetainly work, but not a formal and taxable business arrangement.

The IRS won't allow it, and will be backed up under the substance vs. form doctrine. Basically its saying those expenses would not be deductible to any family. By creating an employer/employee relationship with your husband does not change the nature of the expenses.

desparate for help???? have just got a new a job and they need me to have a bank account to pay my wages into directly! my old bank account was closed down due to me being overdrawn and now im having big problems getting a new one!!! any help would be a godsend?


Answer:Try The Cooperative Bank. They'll let pretty much ANYONE open a very basic bank account.

Answer:You need to apply for a basic bank account with no borrowing facilities until you can build up a good reputation with the bank. Most of the high street banks provide them and you shouldn't have any problems getting one even with bad credit as your not able to go overdrawn, don't issue cheque books or overdrafts. Both Natwest and LLoydsTSB provide them as well as HSBC and Abbey.

If you still have no luck try the post office, they provide very very basic accounts. You can pay money in but to withdraw money you have to go to a post office branch with your ATM card. You can't use the card anywhere else but the post office so it's very limited but it will give you somewhere to pay in your wages.

I bought a condo that has an HOA. I got a notice on my car one day stating my car would be towed if i didnt update my tags. I didnt even know they were expired, but i was going to get new ones on monday (it was wednesday) So come monday I went to go to the DMV and the car was gone! They towed it already. I had to pay $250 to get it out! How can I fight this? Its just wrong, i own this damn condo and thats my parking spot.


Answer:Timing is key. If they gave you a time frame then didn't stick to it, you may have some recourse. But proving it would mean you'd need to know when the car was actually towed, and have all the documentation to prove this. My suggestion is to let it go. By the time you file a small claims suit, you would have spent money that could have been used for a better purpose. Live and grow from this mistake. BUT I would attend the next HOA meeting and give them a piece of my mind in front of all attendee's.

Answer:A lot of condo and apartment complexes have rules against having unregistered vehicles on the property. Your car was unregistered. The HOA was well within their rights to have it removed. They even gave you advance warning! (Keep in mind that if the DMV or the police had seen it, they would have ticketed or towed you anyway, even without the involvement of the HOA.)

Ordinarily, I'm opposed to most of the stuff that HOAs do to their tenants. In this case, however, it was you who dropped the ball by not being aware that your registration was about to expire. That's YOUR responsibility to keep on top of. You didn't. Now you get to live with the consequences.


Answer:Damn, they gave you notice and you ignored it, deciding to do things on your own schedule and on your own time. READ your HOA, as I'm sure it says cars without current tags can be towed. Sure it's your parking spot, but you live in a community and there are rules and you violated them. They even gave you the courtesy of a warning, and you didn't act. How can you fight this? Be proactive. Obey the law. Don't let your tags expire. Obey your HOA rules. Respond immediately to notices.

Answer:NOPE, LLs can choose their tenants for their own property.

Nothing says they have to offer property for rent or sale upon the open market. Renting on open market is when Fair Housing kicks in.

Fair Housing just says they cannot discriminate on prohibited basis when offering property for rent or sale. Renting to only friends does NOT violate that in most cases.

I had two friends sign a lease. There was an altercation between them so one wanted out. We mutually decided to end the old lease.

I drew up a new lease with the girl that wanted to stay and she had her new boyfriend sign with her. They put down the deposit and four months later they both want out. I was going to try and hold them to it but afterwards said if they moved out I would only keep the deposit will let them abandon the lease if they left the place in order. We agreed last day of the month to move and they moved out as expected. However, they busted up the bedroom wall and closet in a cat fight. They also left behind a bunch of garbage. Now one girl says she wants the deposit back, she ststed "we all agreed to terminate the lease and you have to give it back" ? I can do a audit of damages and keep the lease and what about lost rent?


Answer:here in chicago, u can deduct the damaged and mess they did from the deposit. but u have to show it to them. if they agree to fix the damaged at their costs and clean the mess as their costs, then it should be o.k. as long u are happy with it. if they don't, then deduct it and make a audit to show them the costs u paid. if they don't like it, then tell them to take u to court. most likely, the damaged to the wall costs more anyway. then the deposit.

Answer:You do not have to give the deposit back. Most landlords don't no matter what. They will find something to keep it for. If they tore stuff up, abandoned a lease, left garbage, or just didn't clean the place up you can keep it.

I would access the damages and tell her if she keeps on you will sue her for the damages that are above the amount of the deposit and you have proof of the damages.


Answer:Since you acknowledged that you agreed to terminate the lease you can't add lost rent into the equation but you should deduct the cost to get the apartment back up to snuff so that it can be rented out and return what little if any is left over. Patching the holes, clean up, carpet cleaning, closet and paint should eat up about all of it.

What did your lease state about fees or penalty for breaking lease? Mine state retention of security deposit. Tenants are liable for rent until the place is re-rented and are liable for any damages done. Hopefully you documented the damage they did. Send them a letter (should have done this within 30 days of end of lease, end of month, end of occupancy. State that their security deposit was forfeited when they broke the lease (or whatever the lease states) and that in addition they owe $$ for damages (itemize) and $$ for rent until relet.

Answer:You need to specify if the loan was taken out by the owner as a person or the company. Companies are distinct legal persons, much like real people they are seperate from the people who 'own' it.

Was the house put down as security for the company's loan? then the owner of the house is liable and on liquidation the house can be auctioned.

Was the loan taken out by a company whose owner has a house? Then he is not liable unless for example the shares owned by that person have not been paid fully, then the money is still due to the company on liquidation, e.g. say you still have to pay for shares worth £30,000, and you own a house, then you have to pay that money on liquidation and might have to sell your house to do so.

Answer:Well, I think that the first three answers should have helped you. I don't have anything more to add. LOL!

The "Finance sector" could describe many different roles and apply to many industries. So it's hard to speak generally. If you mean to work on Wall Street, I have met people who have had stable jobs for years though they tend to be incredibly demanding. The trend is to burn out for ten years or so and then move to another role. If you're there as a trader, the stress level goes even higher. The compensation, as you have probably heard, is impressive. But one losing year can send you packing.

Off of Wall Street, it may depend upon the industry and exact role. I can only speak to my role. As an actuary/quant in a midwest insurance company, my job is very stable. I usually work right around 40 hours a week, and my job appears pretty secure. Like most insurance companies, my company is well capitalized, so we can withstand deep market downturns and remain solvent.

My major problem has become a growing unease that "money management" jobs are really only in response to the massive production of money via the loose credit policies of our monetary system. It's classic supply and demand. The supply of money has been dramatically increased which has, in turn, attracted people to "manage" it for profit.

I fear that too much wealth has been directed to the finance sector and that society can not forever support it. This has drawn my concern that, perhaps, I am participating in something immoral. It also creates a practical consideration that finance jobs will be lost when our society finally readjusts to economic reality (despite all the efforts of policymakers to avoid that reckoning).

Reality may well be somewhat less than my alarmist views. But in any event, there will always be some demand for finance. Any complex business requires access to the capital markets. And I believe that my particular industry, insurance, will always have a place in society. So you may find a place where you can stay.

In summary, I guess that I have drawn where finance has been and where I think it is likely to go. If my worst views turn out, instability will be general, not just in finance. So you might as well go into something that you enjoy and roll with the changes as they occur.

The finance sector is in some way directly linked to our economic enviroment, unpredictable changes in the economic environment could seriously affect employment in this sector.

I want to be a CNA. When I went to a college to ask about it, all they had to offer was "medical assistant" I'm not sure I want to do that. Where is a good college to go to be get the CNA certification? I would like to be on the track to get to be an RN. I don't know if the Med. Asst. is on that track, and it takes more to get the diploma than it takes to get certification to be a nurse.

Answer:Please note that there aren't supposed to be too many jobs for the MA (or medical biller or coder) despite what those private $$ tech schools say. The MA field is, unfortunately, saturated with graduates looking for work. If you're interested in the field of nursing, I would look into training as a cna either at the local community college (perhaps non-credit course) or county vo-tech school as long as it's accredited within the industry. Please forgo those private expensive programs.

Just a word to the wise that the nursing field is supposed to have a high burn-out rate including cna in which the aide may be dealing with patients that are irritated, aggressive and/or confused and may not want to get a bath or get dressed for the day, know what I mean.

I made an offer monday for a foreclosed home. I offered asking price with 6% closing cost paid by the seller (bank). Apparently there were 3 contracts, one which fell through and now I am guessing it is between us and someone else. So they called my agent to ask was that our "best and final offer", so we offered $1000 more of our own money because we are maxed out on what we were approved for. Does this mean they offered more than us? Does this mean we won't get the home? Please let me know, and if you have been in this situation please let me know your outcome and expierence.

I want to become certified in medical coding and I have been reading a lot of job postings for the postion (from all over the country). My concern is that they are looking for people with experience. Is it going to be very difficult for me to get a job after taking this course? Is it even worth my time…if they are looking for experience at the onset, doesn't that rule me out before I get a chance to try??? What to do?

Okay i was in a car accident when i was four. Drunk driver 18 wheeler. Made it out alive By the Grace of God.

We sued, when i turned 18 i started receiving checks from the settlement money. the way it set up is 2500 twice a year until i'm 21 it will stop for a few years & then at like 25 & 27 i will receive a big check

my payment of $683 is due on the 15 of each month, my interest rate is 14.19% i had a 72 month loan and i have 58 payments to go. i was told if i made my payment on the first instead of the 15 i will shave off some of the interest and pay and additional $100 a month it will take off some of my payments in turn saving me money and being able to pay off my car early, if this is true how much will i save and when will i be finish paying off my car


Answer:Well, first off, having a car loan for 72 months at 14.19% is criminal in my mind. I just got a 5 year car loan and am paying 5.15%.

I did a little work with a spreadsheet since you gave me enough info to actually work out the whole thing. I have calculated that you borrowed a princely $32,985 towards the purchase of your vehicle.

If you paid on the 15th for the entire loan, you would pay out a total of approximately $49,176. After by paying on the 1st of each month starting with the 15th payment you would save about $304…. ho hum. If you additionally increase the monthly payment by $100, this will save you an additional $2,306, not bad. Especially since it gets paid off 10 1/2 months early.

If there is any way to refinance this car and get a better interest rate, I would do that. If you had gotten a 5.15% loan like I did and paid $683 a month you would have it paid off 18 months early and save $12,193 compared to your original scheduled loan.

I can only assume that you financed the car at the car dealership and did not do any comparison shopping. I hope also that you declined credit life insurance, always a bad idea. Sometimes car lots will get you financing through your own bank or credit union, but for some reason, the rates will be much higher.

Your present loan is at a hideous rate. You should aggressively look for a way to refinance it at a more friendly rate. It is smart of you to be asking this question. To answer your question took me about 15 – 20 minutes of my time working with an electronic spreadsheet and backing into the borrowed amount. I am glad to do this on behalf of someone like yourself who is exploring ways to take control of your personal finances.

I start training at amc theaters tomorrow and im extremely nervous. I have had the worst experience dealing with customers when I worked at bjs wholesale that i quit the second day. Unfortunately these type of jobs are the only ones that are hiring until i get my degree. I'm just wondering if working at the movie theater a fun experience? is being a concessionist/usher a hard job? did you have to work holidays? please share your experience


Answer:I worked at AMC in Milwaukee WI for almost a year and when I first started it was pretty fun. We had to do about 3 days of training out of a book and watch a lot of cheesy movies. They usually start everyone off in concessions since its the hardest, then later they train you in ushering. Working in Concessions is mostly on the register and getting popcorn and drinks, but ushering you have to go around and clean all the theaters and every theater is supposed to be cleaned in 5 minutes or less. And yes AMC requires you to be able to Work all holidays and weekends since those are usually when a lot of movies come out ESPECIALLY Christmas. You get to see free movies when your not working with a family member and/or guess and when your working your immediate family members can also come see a free movie. oh yeah ticket taker is the most boring because you just stand there collecting tickets

Is that weird to copy your friends voicemail message?

I work at home with my husband managing our small but successful business firm, which is a pleasure most of the time. We work long draining hours, and sometimes I am just not in the mood to speak with friends that call me. Im in my late 20's, and a lot of friends that call me dont have much going on in their lives because they are either out of work, or are wanting to vent about their problems in life. I am all for being a friend but lately I have been passing up on answering their calls.

Meanwhile: I got in touch with an old childhood friend. I havent even seen her in over 15 years. We've seen each others photos on facebook/etc and have talked several times throughout 2009, having a great time on the phone with continual laughs and memories. I called her last night and got her voicemail to which I LOVE the message. She said;

"Hey, its Celina, I cant answer my phone right now because im working, or I'm simply busy, leave a message and I'll get back to you"

I LOVED it because its so realistic and different than all of the others hundreds of voicemails i've heard throughout the years.

I told her last night that I loved her voicemail and that its the best one of heard in my life and how i'm gonna use it one day. But I was kind of saying sarcastically, I guess…she then responded with how she's heard a lot of them (hiring people and such) and told me some of the worst ones she's ever heard. She really has a great personality, and I dont really think she would care. None of my friends/colleagues know her…so they wouldnt know if I coppied it…only her. I dont think she would care, but is there any way to change it around? I just love the way hers is word for word….Whudya think?

Answer:go for it. its just a phone message and im sure she would be flattered. i have done it myself and it was someone who we shared friends and knew i did it. she did not get offended.

What education/license is needed to prepare wills

I would like to learn how to prepare wills and trusts for part-time income. Would I need to become a lawyer in order to do it legally? What education, experience and/or licensing would be needed in order to practice that kind of service?

I have some college credits from a few years ago, but dropped out of college and started working with horses. I am currently the manager of an equestrian breeding facility, and would like to find a job that's a little less time consuming (I work 6 days 70 hrs a week with no holidays or vacations off) i can only attend college online due to my demanding job. I would love to stay working with animals but not sure where to go….or what to do!!
